Transcription of the will of Francis Pank dated 24 February1797

I Francis Pank of West Runton in the county of Norfolk Bricklayer and Farmer do by this my last Will and Testament give and devise all those messuages lands tenements cottages and hereditaments with the appurtenances situate in Cromer otherwise Shipden in the said County and late my Mother's and all that messuage or tenement with the Blacksmiths Shop Shoe house Leantoo and appurtenances in Cromer otherwise Shipden aforesaid in the use of Thomas Leak or his assigns And also all that parcel of Arable Land containing by estimation six acres more or less with the appurtenances situate in West Runton aforesaid and also all those two tenements and cottages late of the widow Dennis with the land and appurtenances in West Runton in the said County and also all and any other my real estate whatsoever not hereinafter otherwise devised and disposed of (the Copyhold parts of all of which said premises I have duly surrendered to the use of my will) unto my Son Francis Pank his heirs and assigns chargeable nevertheless with such legacies and sums of money in aid of my personal estate as hereinafter specified, in case the same should fall short. And all that my free tenure messuages and tenements situate in East Runton aforesaid wherein John Adcock my son in law dwells with the appurtenances late the Estate of John Love I give and devise unto the said John Adcock and my Daughter Sarah his wife and their assigns for their joints natural lives and the life of the survivor. And from and after the decease of such survivor unto my Grand Son Francis Adcock his heirs and assigns. And I give and devise all that my lands known by the name of Husses Yards with the appurtenances situated in East Runton aforesaid (the Copyhold parts whereof I have also surrendered to the use of my will) unto my Daughter Ann the Wife of Thomas Platten and to her heirs and assigns. And all that my messuage or tenement with the barn stable yards gardens lands hereditaments and appurtenances situate in West Runton aforesaid and in Beeston Regis next or near adjoining in the said county of Norfolk (and which I have also surrendered to the use of my will) I give and devise unto Thomas Pain and my Daughter Rebecca the Wife of the said Thomas Pain and their assigns for and during the term of ninety-nine years if they shall so long live. And from and after the expiration or other sooner termination of the said term I give and devise the said premises with the appurtenances unto and to the use of the heirs of the body of her the said Rebecca Pain lawfully issuing whether son or daughter and to his or her heirs and assigns forever. But if the said Rebecca Pain my Daughter shall happen to depart this life without leaving any child or children or the issue of any such living at her decease Then and after the decease of her said husband I give and devise the said premises with the appurtenances unto my aforesaid son Francis Pank his heirs and assigns subject and charged as aforesaid and herein after specified. And I give and bequeath the sum of Sixty Pounds to my aforesaid daughter Ann the wife of Thomas Platten within six calendar months next after my decease. And to John Pank my Grandson now or late of Sunderland Mariner, son of John Pank my deceased Son, the sum of fifty Pounds within twelve calendar months. And to Alexander Culham Pank my Grand Son of King's Lynn in the County of Norfolk son of my deceased Son Matthew, the sum of thirty pounds within nine calendar months. Also to my Grand Daughter Mary Love, daughter of John Love and Elizabeth his wife my late Daughter deceased, the sum of one hundred pounds within twelve months next after my decease if she shall have attained her age of twenty one years and if not, then only at such age. Also the sum of fifty pounds to my Daughter Mary the wife of John Abbs or her legal representatives (excepting her husband in such case as after expressed) within six calendar months if her said Husband before my decease as requested shall have given up and conveyed to me or do within such six months after my decease at the request of my aforesaid son of Francis Pank his heirs or assigns give up and duly convey at and for the clear price or sum of three guineas the twenty six perches of field land lying in Cromer Lane Furlong, late part of Goss' Land devised to the said Francis Pank as above said and which were exchanged with him the said John Abbs for more and other part thereof. But if he shall not in my lifetime have so given up and conveyed the said twenty six perches of land or do not after my decease give up and convey the same as aforesaid according to the true intent and meaning hereof then the said legacy of fifty pounds shall not be paid my said Daughter or her representatives until one month next after the decease of her said Husband. And if she shall not survive him and he shall not have so given up and conveyed the said twenty six perches of land as aforesaid then the said legacy to lapse sink and go into and with and be taken as part of the residue of my personal estate hereinafter disposed of to the said Francis Pank. Also I give to my aforesaid Daughter Sarah Adcock the sum of twenty pounds within nine months after my decease. And in aide of my personal estate in case the same shall by any means prove insufficient fully to satisfy and discharge the several legacies and sums herein above given and directed to be paid or in case of neglect or default of payment of either or any of them as and when the same shall respectively become due I do hereby subject and charge all and singular my messuages lands tenements hereditaments and premises whatsoever herein devised to my said son Francis Pank his heirs and assigns to and with the payment of the said legacies and sums or so much in such parts thereof as my personal estate shall fall short of satisfying. And it is my will that in such cases it shall be lawful to and for the person or persons to whom the said money shall respectively be due into and upon the said premises and or any part or parts of the same to enter and to hold and enjoy the same and receive the rents issues and profits thereof to his her or their own use until fully satisfied the money so due and unpaid together with all reasonable and necessary costs charges losses and expenses incurred and occaisioned thereby. And all my household furniture plate china linnen and woollen goods implements and materials of household and other effects whatsoever at the time of my decease being in upon and about the dwelling house now or in my occupation (farming goods implements utensils and materials of husbandry and other things appertaining thereto wearing apparel of all sorts monies and securities for money only excepted). I give and bequeath unto and to and for the sole and only use benefit and disposal of my aforesaid Daughter Rebecca Pain and to be delivered to her as soon as conveniently and reasonably may be after my decease, without the control or interference of her present or any after taken husband. And all my farming goods implements utensils and materials of husbandry dead and live stock crops corn grain pulse grass hay and other things whatsoever in that line and then appertaining to the same not herein before and after otherwise disposed of which I now am or at my decease shall be possessed of interested in and entitled unto, I give and bequeath unto my aforesaid Son Francis Pank and my Daughter Rebecca Pain equally to be divided between them in specie or value as near as may be share and share alike and the part and share of my said daughter to be to and for her sole benefit and disposal as aforesaid. But in case my said son and daughter or any proper indifferent person on her behalf cannot agree in and about the same than the same to be divided valued adjusted settled and delivered by and as two indifferent persons of judgment shall set and direct, and to be chosen by my said son and another by my said daughter. And my wearing apparel of all kinds monies securities for money and residue of my personal estate and effects of what nature or quality and soever, not herein before or after otherwise bequeath and disposed of, which may fall in and lapse (in aid or exoneration of my real estate given and devised to my said Son Francis Pank his heirs and assigns as aforesaid) subject to, and from and after payment and satisfaction of, my funeral charges probate of this my will, debts the legacies and monies abovesaid and all charges of and attending of the execution of my said well I give and bequeath to my said Son Francis Pank and his legal representatives. And lastly I do hereby appoint him my said son and Mr. Benjamin Barcham of Lower Sheringham in the said County of Norfolk Shopkeeper executors of this my said Will and do give to the said Benjamin Barcham five guineas for his care in the due execution and discharge of the burden thereof on his part over and above all and any necessary expenses in attending the same according to the true intention and meaning hereof. In witness whereof I have to the first three sheets of my said Will set my hand and to this last sheet thereof (all the said four sheets being affixed together at the top and there sealed) put my hand and seal this twenty fourth day of February in the year of our Lord Christ one thousand seven hundred and ninety seven.
